Bullying may include, but is not limited to, repetitive instances of teasing, social exclusion, threats, intimidation, stalking, physical violence, theft, harassment, public or private humiliation, or destruction of property. If physical harm or psychological distress is not the result of systematic or chronic behavior, evaluate for Harassment.

SESIR Bullying must include 3 elements: It must be 1) repeated; 2) intentional; and 3) involve a power imbalance.

(Undesired sexual behavior) Unwanted verbal or physical behavior with sexual connotations by an adult or student that is severe or pervasive enough to create an intimidating, hostile or offensive educational environment, cause discomfort or humiliation or unreasonably interfere with the individual's school performance or participation (6A-19.008(1) SBE Rule) (Word).

NOTE:

The following criteria must be met in in order for the behavior to be considered SEXUAL HARASSMENT UNDER TITLE IX:

• The conduct was sexual in nature or based on sex-stereotyping.

• The conduct was unwelcome.

• The conduct was sufficiently severe, pervasive, persistent, and objectively offensive.

• The incident effectively denies the student equal access to the school’s educational program or activity.
